Terms of Service
Effective Date: October 16, 2026
1. Acceptance and Operator
These Terms of Service govern your use of SportQuantix.com and its related web application and services (collectively, the “Service”). The Service is operated by Sport Quantix (“SportQuantix,” “we,” “us,” or “our”). By creating an account, subscribing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and legally capable of entering a binding agreement. You are responsible for complying with laws applicable to your use of the Service. We may restrict access where required by law or licensing obligations.
3. Informational Sports Analytics Only
SportQuantix offers sports statistics, historical analysis, player and team information, and independent probabilistic forecasts for informational and educational purposes. We do not operate a sportsbook, accept wagers, facilitate gambling transactions, or guarantee outcomes. Nothing on the Service is financial, investment, or gambling advice.
4. Forecast and Data Limitations
Forecasts are estimates based on models, assumptions, and available data, not statements of certainty. Sports results, player availability, lineups, injuries, and other inputs can change without notice. Data may be delayed, incomplete, revised, or inaccurate. You are responsible for evaluating information independently and for decisions you make using the Service.
5. Accounts and Security
You agree to provide accurate account information, maintain the confidentiality of your credentials, and promptly report suspected unauthorized access to support@sportquantix.com. You may not transfer or sell your account or permit unauthorized access. We may take proportionate steps to protect account and platform security.
6. Plans, Billing and Renewal
Free and paid plans, features, prices, billing intervals, taxes, trials, and any promotional conditions are described at the time of purchase. Paid subscriptions renew automatically at the disclosed interval unless canceled before the next renewal, subject to applicable law. The payment provider identified during checkout processes payments and may apply its own payment terms. We will present material recurring-payment terms before purchase.
7. Cancellation and Refunds
You may cancel renewal using the account billing controls or by contacting support@sportquantix.com. Unless a different term is disclosed at purchase or mandatory law requires otherwise, cancellation stops future renewal and access continues until the end of the paid term. Refunds are provided where required by law or expressly promised at checkout. This section does not limit statutory consumer remedies.
8. Permitted Use
We grant you a limited, personal, nonexclusive, nontransferable right to access the Service under your subscription and these Terms. You may not scrape or systematically extract data; resell, redistribute, or sublicense content; reverse engineer protected components except as permitted by law; evade usage limits; interfere with security; or use the Service unlawfully. Any commercial or API use requires our express authorization.
9. Intellectual Property
The Service’s original software, designs, analytics, branding, models, and other proprietary content belong to SportQuantix or its licensors. Third-party sports data and team or league trademarks remain the property of their respective owners. No ownership rights are transferred to you.
10. Feedback and Submissions
If you provide feedback, suggestions, or content through features that permit submissions, you confirm you have the necessary rights. You authorize us to use submitted material to operate the Service and to use nonconfidential suggestions to improve it without compensation, subject to applicable privacy law.
11. Affiliate Program
Any affiliate or referral program is subject to its own separate terms, enrollment requirements, and applicable disclosure laws. Participation is not granted solely by accepting these Terms.
12. Changes, Suspension and Termination
We may update the Service, modify features, or suspend access where reasonably necessary for security, misuse, licensing, or legal compliance. Where required, we will provide notice and applicable remedies. You may stop using the Service at any time and cancel paid renewals under Section 7.
13. Third-Party Services
Certain functionality may depend on third-party data, hosting, authentication, payment, or other providers. Their separate terms and privacy notices may apply. We do not control external websites linked from the Service.
14. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES NOT EXPRESSLY PROVIDED IN THESE TERMS. THIS DOES NOT EXCLUDE WARRANTIES, CONFORMITY RIGHTS, OR REMEDIES THAT CANNOT LAWFULLY BE EXCLUDED.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OR LOST PROFITS ARISING FROM USE OF THE SERVICE. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR US \$100. THESE LIMITS DO NOT APPLY WHERE PROHIBITED BY LAW, INCLUDING TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED.
16. Wyoming Law
These Terms are governed by the laws of the State of Wyoming, excluding its conflict-of-laws rules, except where federal law or mandatory consumer protections require otherwise. The Federal Arbitration Act governs the interpretation and enforcement of the U.S. arbitration agreement below to the extent applicable. This choice of law does not deprive consumers of mandatory protections available in their country or state of residence.
17. Binding Arbitration and Dispute Resolution
17.1 Informal resolution. Before starting arbitration or litigation, you and SportQuantix will first send a written description of the dispute, the relevant account email, and the requested resolution. Send notices to support@sportquantix.com; we will contact you at your registered email. The parties will attempt in good faith to resolve the dispute for 30 days. This requirement does not prevent emergency relief, eligible small-claims proceedings, or the exercise of rights that cannot legally be delayed.
17.2 United States consumer arbitration. If you reside in the United States and the dispute remains unresolved, you and SportQuantix agree to resolve disputes arising out of or relating to these Terms or the Service through final, binding, individual arbitration administered by the American Arbitration Association (AAA) under its applicable Consumer Arbitration Rules, rather than in court, except as stated below. The Federal Arbitration Act applies to the extent permitted by law. Arbitration may be conducted remotely, on written submissions, or in a reasonably accessible location under the applicable rules. The arbitrator may award any individual relief available under applicable law.
17.3 Fees and fairness. Filing, administrative, and arbitrator fees will be allocated under the AAA Consumer Arbitration Rules and applicable law. SportQuantix will pay fees allocated to it by those rules or required by law. No provision of this agreement requires a consumer to pay costs that would make the arbitration agreement unenforceable.
17.4 Exceptions and individual proceedings. Either party may bring an eligible individual action in small-claims court. Either party may seek temporary injunctive relief from a court where necessary to prevent imminent harm or protect intellectual property, without waiving arbitration of other claims. To the extent permitted by applicable law, claims must proceed individually rather than as class, collective, or representative actions. This restriction does not waive public injunctive relief or other remedies that applicable law makes nonwaivable. If a particular claim or remedy cannot lawfully be arbitrated on an individual basis, that claim or remedy may proceed in a competent court as required by law.
17.5 Opt-out. You may opt out of the arbitration agreement within 30 days after first accepting these Terms by emailing support@sportquantix.com with the subject “Arbitration Opt-Out” and your name and account email. Opting out does not affect any other provision of these Terms.
17.6 EU/EEA and other international consumers. This mandatory pre-dispute arbitration agreement does not apply to consumers habitually resident in the European Union or European Economic Area. Such consumers retain access to courts and remedies available under applicable mandatory consumer law. Consumers outside the United States and EU/EEA retain any nonwaivable rights to local courts and remedies under applicable law; arbitration may be used only to the extent a pre-dispute agreement is legally valid and enforceable in their jurisdiction, or by mutual agreement after a dispute arises. Voluntary mediation or other alternative dispute resolution remains available by mutual consent.
17.7 Severability and administration. If a portion of this Section is unenforceable, the remainder remains effective to the extent legally permitted, except that a claim or remedy that cannot be individually arbitrated will proceed in a competent court as required by law. If AAA cannot administer a dispute, the parties may agree on a comparable neutral administrator; otherwise a court with jurisdiction may determine the appropriate forum or relief consistent with applicable law. No provision restricts complaints to regulators or supervisory authorities.
18. California Consumer Protections
California residents retain all applicable rights under California consumer protection, automatic-renewal, and privacy laws. We will disclose recurring charges and cancellation terms as required by applicable law. Nothing in these Terms waives rights that cannot legally be waived.
19. EU/EEA Consumer Rights
Where EU/EEA consumer law applies, you retain mandatory precontractual disclosure rights, statutory digital-service conformity remedies, and applicable rights to cancel or withdraw. Eligible consumers generally have a 14-day withdrawal period for distance contracts, subject to legally valid exceptions. Any request for immediate performance or acknowledgment affecting withdrawal rights must be obtained separately where required. The applicable checkout disclosures and mandatory law control. Nothing in the dispute resolution provision requires EU/EEA consumers to waive access to their legally competent courts or to accept mandatory pre-dispute arbitration.
20. Updates to Terms
We may revise these Terms as the Service or applicable law changes. The version in effect when you use the Service governs, subject to required notices, consent, and other mandatory consumer protections. Material changes will be communicated where required by law.
